FCC Order Regarding The 486 Application
09/15/2006
The FCC released an order, DA 06-1871, granting relief for certain applicants who failed to file a timely Form 486 on September 14, 2006. The FCC advises that USAC must develop targeted outreach procedures to inform applicants of approaching Form 486 deadlines and provide an opportunity for applicants to submit certifications within 15 days after the deadline. USAC will post detailed guidance to the website as it becomes available.

FCC Issues Public Notice on Eligible Services List

On July 21, 2006, the FCC released a Public Notice (FCC 06-109) including the Draft of the Eligible Services List for Funding Year 2007. This furthermore established the comment period for the Funding Year 2007 Eligible Services List.
Comments on the draft Eligible Services List, which is attached to the Public Notice, are due to the FCC on or before August 4, 2006. Reply comments are due to the FCC on or before August 14, 2006. For information on filing comments with the FCC, please refer to the Public Notice.
USAC has prepared a list of the Principal Proposed Changes and a version of the Draft list with active links to assist the comment process.

Funding Year 2006: Form 486 Notification Letters

USAC advises that the first batch of Form 486 Notification Letters for FY2006 will be dated and mailed June 21. This batch should include letters to applicants that certified Forms 486 before June 14 and to service providers with Service Provider Identification Numbers (SPINs) featured on those forms. New batches of letters will then be generated and mailed on a weekly basis.
Administrative Change: Deadlines for Information Requests

Beginning in early June, USAC moved from a seven-day deadline for responses to information requests to a 15-day deadline, to conform to the response times mandated by the FCC in the first appeals remand order FCC 06-54. This means that, in general, applicants and service providers will have 15 days to respond to a request for information from Program Integrity Assurance (PIA) review, problem resolution, and other USAC functions.
In the past, USAC asked for information to be returned within seven days. After seven days, USAC sent a reminder and automatically allowed another seven days for the applicant or service provider to respond. Now, applicants and service providers will have 15 days to respond to such request, with a reminder sent one week before the information is due. Extensions will be granted but extensions longer than one week will require special approval.

Please Note: USAC did not post a wave 47 to their website. According to the Schools and Libraries Division's Help Desk there was a problem with issuing wave 47. Those FCDLs intended to be a part of this wave were subsequently issued as a part of wave 48.
Funding Year 2006 - On May 16, 2006 wave 4 will be released for Funding Year 2006. As of today, USAC has released over $203 million in commitments for approved Priority 1 requests (Telecommunications Services and Internet Access).

This first wave for Funding Year 2006 is being released nearly two months earlier than the first wave in Funding Year 2005. USAC advises waves for Funding Year 2006 will be issued on a weekly basis.

On March 23, 2006 the SLD released wave 40 for Funding Year 2005. The SLD notified applicants of their commitments totaling $73,010,099.57. This was the first wave in which the SLD was authorized to fund Priority Two requests down to 88%. The SLD has committed $1.44 billion with $1.17 billion still pending in 2005.

Funding Year 2006: USAC Provides Demand Estimate to the FCC

The Universal Service Administrative Company (USAC) has reported to the FCC that it had an estimated $3.55 billion has been requested in eRate funding by applicants seeking discounts for Funding Year 2006. This estimate was based on the amounts requested as a part of 39,416 applications received or postmarked by the close of the Form 471 application filing window on February 16, 2006.
Ultimately this dollar amount will be reduced as USAC process the applications and eliminates duplicate requests, ineligible services, and those requests otherwise inconsistent with program rules.

Yesterday the Federal Communications Commission approved the release of funding for Funding Year 2005 Priority 2 commitments down to the 88% discount level. USAC has also determined that funding will not be sufficient to fund Priority 2 requests below 77%.
Upcoming Funding Year 2005 Waves will include approvals for Internal Connections and Basic Maintenance down to the 88% discount level and denials of all Priority 2 requests below 77%.

The SLD released two small waves toward the end of last week bringing the total committed amount committed for Funding Year 2005 to 1.35 billion dollars. Wave 38 contained $4,600,959.67 in Funding Commitment Decisions while Wave 37 granted $14,822,856.18.
